Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) govern your use of the Blutik mobile application and website at blutik.fan (collectively, the “Platform”). By creating an account or using the Platform, you agree to be bound by these Terms, our Privacy Policy, and any community guidelines or contest rules published on the Platform.

If you do not agree, do not use the Platform.

These Terms apply worldwide. If any provision of these Terms conflicts with mandatory consumer protection laws in your jurisdiction, the mandatory local law prevails to the extent of the conflict.

We may update these Terms from time to time. Material changes will be communicated through the Platform, and your continued use after changes take effect constitutes acceptance.

2. Eligibility

You must be at least 13 years old to use the Platform.

If you are between 13 and 18 (or the age of majority in your jurisdiction), your parent or legal guardian must review and agree to these Terms on your behalf.

In India, under the Digital Personal Data Protection Act (DPDPA), users under 18 require verifiable parental consent for processing of personal data.

In the United States, users under 13 are not permitted to use the Platform in compliance with COPPA.

In the European Union, the minimum age of digital consent varies by member state (generally 13 to 16). Users below the applicable age require parental consent.

3. Your Account

3.1 Registration

You create an account by verifying your phone number via SMS one-time password and setting up a profile with a display name and username. You must provide accurate information.

3.2 Security

You are responsible for all activity on your account. Do not share your verification codes or allow others to access your account. Notify us immediately at support@blutik.fan if you believe your account has been compromised.

3.3 Account Deletion

You may delete your account at any time from within the app (Settings > Account > Delete Account). Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

4. Acceptable Use

When using the Platform, you agree not to:

  • Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, or otherwise objectionable
  • Post content that promotes hatred, violence, or discrimination
  • Impersonate any person or entity
  • Post another person's private information without their consent
  • Harass, stalk, threaten, intimidate, or bully other users
  • Send unsolicited messages, spam, or unauthorized advertising
  • Use automated tools, bots, scrapers, or scripts
  • Attempt to hack, reverse-engineer, or compromise the security of the Platform
  • Upload malware, viruses, or other harmful code
  • Use the Platform for any activity that violates applicable law
  • Infringe on the intellectual property rights of others

We reserve the right to remove content and suspend or terminate accounts that violate these Terms.

5. Content

5.1 Your Content

You own the content you create on the Platform. By posting content, you grant Blutik a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, display, distribute, and store Your Content solely for operating and providing the Platform. This license ends when you delete Your Content or your account.

5.2 Content from Other Users

Blutik is not responsible for content posted by other users. User content does not represent our views or endorsements.

5.3 Content Moderation

We use a combination of automated AI systems and human review to moderate content. Moderation decisions can be appealed by contacting grievance@blutik.fan.

5.4 Copyright Complaints

If you believe content on the Platform infringes your copyright, send a written notice to legal@blutik.fan.

6. Contests

6.1 Participation

Blutik offers quiz-based contests tied to sporting events.

6.2 Rules

Contests consist of multiple levels of questions with accuracy thresholds. Scoring is based on correct answers and response speed.

6.3 Video Submissions

After completing a contest's final level, you may submit a short video.

6.4 Winner Selection

Winners are selected at Blutik's sole discretion. Our decisions on winners are final.

6.5 No Gambling

Blutik contests are not gambling. There is no entry fee.

6.6 Compliance

Contests are operated in compliance with applicable laws.

7. Communities

Communities are created and managed by Blutik administrators. Moderators can remove posts and ban members. Moderation decisions can be appealed at grievance@blutik.fan.

8. Messaging and Calls

Messages: Direct messages are encrypted with server-managed keys.

Voice Calls: Voice-only, audio is not recorded or stored.

Privacy Controls: You can control who may message and call you in Settings.

9. Blutik Points

Blutik Points are a virtual reward system for engagement. Points have no monetary value and cannot be exchanged, transferred, sold, or redeemed for cash or goods.

10. Intellectual Property

10.1 Blutik's IP

The Platform is owned by Blutik. You may not copy, modify, distribute, sell, or reverse-engineer any part of the Platform.

10.2 Third-Party Trademarks

Blutik is not affiliated with, endorsed by, or sponsored by any sports league, team, governing body, or organization.

11. Disclaimers

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” BLUTIK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

BLUTIK IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO BLUTIK IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify and hold harmless Blutik from claims arising from your use of the Platform, Your Content, or your violation of these Terms.

14. Suspension and Termination

14.1 By You

You may stop using the Platform and delete your account at any time.

14.2 By Blutik

We may suspend or terminate your account if you violate these Terms.

14.3 After Termination

Your license to use the Platform ends immediately. We retain your data for 180 days post-termination as required by Indian IT Rules, after which it is deleted.

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of India.

15.2 Arbitration

Disputes may be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996 (India).

15.3 Class Action Waiver

Disputes must be brought on an individual basis.

16. Grievance Redressal (India)

Grievance Officer Email: grievance@blutik.fan. Complaints acknowledged within 24 hours, resolved within 15 days.

17. Accessibility

We are committed to making the Platform accessible. Contact support@blutik.fan for issues.

18. General

Severability, No Waiver, Entire Agreement, Assignment, Language provisions.
